The European Low Fares Airlines Association (ELFAA) officially lodged its legal challenge against recently passed European Union legislation on air passenger compensation for cancellations and long delays in the UK High Court last week. The association claims the new rules, due to enter into force next year, are illegal since the fines are not proportional to fares and the rule holds airlines responsible for compensation even when delays are caused by third parties. ELFAA is unable to challenge the regulation through the European Court of Justice until it has been deemed illegal by a national court.
