US Airways is counter-suing Boeing in an ongoing dispute over the airline's switch to Airbus Industrie for its narrow-body fleet renewal programme. Boeing says US Airways broke purchase agreements.

In its third-quarter results filing with the US Securities and Exchange Commission (SEC), US Airways says that on 31 October it filed an answer to a Boeing lawsuit issued in September and a counterclaim.

US Airways' filing says it denies liability to the Boeing claim and that it is "-seeking recovery from Boeing of approximately $45 million in equipment purchase deposits and past overcharges".

Boeing issued a lawsuit against US Airways on 11 September alleging that the carrier had broken purchase agreements linked to an order for eight Boeing 757s and 40 Boeing 737s.

Boeing's lawsuit, according to US Airways' SEC filling, "-seeks among other things, monetary damages of an unspecified amount". The airline says it "-intends to vigorously defend the Boeing law suit".
